		<description>If someone has registered a trademark, I wouldn't go near that name if you are promoting the same product. Sooner or later you'll get a lawyer onto you using words like 'passing off' and you could lose not only all your hard work, but potentially have to hand back your revenues.

I'd only use the name if it was for a significantly different purpose not covered by the trademark.
